The Shiloh Nouvel photo debacle

By now you've surely seen the contentious first published picture of Shiloh Nouvel Jolie-Pitt, posted on this site Tuesday morning as well as on numerous other celeb sites and blogs (and since removed from most, including mine). The photo - a cover of Hello! magazine accompanied by the headline "The biggest exclusive of the year: Angelina and Brad with their new baby Shiloh Nouvel" - was not due for public release until Thursday, and was clearly leaked. Angelina Jolie and Brad Pitt announced an agreement on Monday with Getty Images to market the first pics of their newborn, with proceeds going to charity, but a spokesperson for People magazine, who had reportedly secured North American rights for the images for $4.1 million, said, "Somebody from Hello! must have leaked it... I'm sure it's a legitimate cover. I don't know how it got there." A spokesperson for Getty Images said today that the agency's lawyers are investigating to find out how the picture was leaked.

Meanwhile...Gawker.com has published a series of email messages between Time Inc.'s legal counsel, Nick Jollymore, and Gawker's editor, Lockhart Steele, which starts out something like this:

Dear Mr. Steel,
We will be sending you more formal legal notices shortly. Gawker's posting of the Hello! magazine cover with Angelina Jolie and Brad Pitt is an infringement of Time Inc.'s exclusive rights to that photograph. I need to talk to you or your attorney immediately.
